1.Introduction

1.1 Trust-net – is a Website powered by Merchant trust ltd.  

1.2 The Website facilitates the purchase of goods and services from person to person, from shops, importers, businesses and such-like.  The payment for the purchase is made through the use of credit cards, electronic checks and Trust-net registered accounts. 

1.3 The directions in these Rules and Regulations apply to any and every use of the Website as well as to any purchase made through it. 

1.4 Wherever in this Document the word "person" appears the intention is to one person or to a group of persons whether a corporate entity or not.  Everything stated, written and referring to the singular includes the plural and vice-versa.  Everything stated, written and referring to the masculine, neuter or feminine gender includes each and all of them. 

1.5 The use of the Website and the execution of purchases made through it will be considered as expressing full agreement with this Statement of Rules and Regulations and acceptance of all the conditions herein.

1.6 Trust-net reserves the right to make changes to this Statement, wholly or in part. In such a case, such changes as are made will become effective immediately after appearing on the Website.  Transactions made through the Website prior to such changes will remain subject to the Rules and Regulations applicable immediately prior to the changes.

 

 

2. Definitions 

2.1 The following terms will be applied per the definition given alongside them, unless the context otherwise requires.

2.4 Bank or Financial Institutions: are those specified in the FDIC Act and Regulations in the United States and/or the Israel Banking (Licensing) Law, 1981 and the Banking (Service to Customers) Law, 1981 according to the consumer’s billing address.

2.6 Product, Service: Every and any product, service, information, asset, money, rights and suchlike which were purchased or sold through the Website in accordance with the provisions in this Statement of Rules and Regulations. 

2.7 Supplier, Provider or Seller: Any shop or business or whatever nature, appearing on the Website as offering products or services.

 

3. Orders 

3.1 Suppliers, Providers or Sellers selling their products and services are displayed on the Website.   Every one of them displays its own product or service and its own terms of sale, prices, terms of payment, date of supply. 

3.2 Orders for the purchase of products or services from the Supplier, Provider or Seller will be made through the Website. The Website will forward the order to the relevant Supplier, Provider or Seller in order that it may execute and supply the order for products or services as between them and the Customer. 

3.3 The Supplier, Provider or Seller bears the sole responsibility for the quality and proper condition of the product, for its complying with the Order, its features and its effective supply to the Customer, as well as for carrying out all further commitments imposed upon them according to Law.

 3.4 Inquiries concerning any subject and topic connected to the product or service ordered and its supply will be submitted by the Customer directly to the relevant Supplier, Provider or Seller according to the details and conditions displayed on the Website.

3.5 According to its policy, Trust-net does not supply its services to Suppliers, Providers or Sellers who do not advertise their telephone numbers nor e-mail support addresses on the Website. This policy is in order to protect and assist registered Trust-net's Customers.

 

4.Payments

4.1 Payments to Suppliers, Providers or Sellers for their products or services will be made through Trust-net’s payment gateway servers. 

4.2 Trust-net's payment servers will carry out confidential data transfers for its Customers employing only methods that will ensure the protection and inviolability of personal details and the secrecy of the Customer form of payment and/or credit card details.

Trust-net will transfer data employing the SSL (full name) encryption system.  Employing the most advanced methods available to electronic commerce and e-commerce business activity.
Trust-net is entitled at all and any time to modify the payment method and to improve it, employing other advanced methods or additional methods, in order to protect the Customers of the both sides, and their privacy. 

4.3 Upon receipt of the Order details by Merchant Trust Ltd, the Order will be forwarded to the recognized Supplier, Provider or Seller.  Simultaneously, the details will be passed through  Trust-net risk management anti-fraud systems before it is transmitted to the Credit Card company, Bank or Financial Institution in order to debit the Customer's account.

The Credit Card company, in accordance with its own rules and regulations, will credit Trust-net account for the purchase of the product or service, and in accordance with the terms of the Order.  Merchant Trust Ltd will pay the Supplier, Provider or Seller for the Order in accordance with the agreement signed between Trust-net and the Supplier, Provider or Seller.

 

5. Merchant Trust Ltd Obligations towards the Customer 

5.1 TRUST-NET is obliged to cancel the transfer of funds to the Supplier, Provider or Seller whenever the Customer notifies  Trust-net of cancellation of the transaction for the purchase of the product or service, all according to the terms and timing of events as detailed below. 

5.1.1 Product or service not provided- Trust-net will enquire from the Supplier, Provider or Seller whether the product or service was supplied or not.  If not, Trust-net will cancel the transaction immediately following the Customer's notification and after. Confirmation whit the supplier.  Trust-net will also notify the Supplier, Provider or Seller of the cancellation and advise that it no longer needs to supply the product or service.

Notification by the Customer must be given within 30 days from the date the credit card was charged, employing the Online Form via the following link, - Canceling a Transaction, - advising that the product or service had not been provided and that the Customer is therefore canceling the order from the Supplier, Provider or Seller.  

5.1.2 Cancellation of the transaction under Israel: Consumer Protection Law, - 1981 Trust-net will cancel the transaction if the Customer's notification of cancellation was given in accordance with this Law and the product or service has not yet been supplied by the Supplier, Provider or Seller.  In the case of such a cancellation, the payments deducted from the Customer's account will be reimbursed. The cancellation of the transaction must be made in accordance with this Law and within 30 days from the date the credit card was charged, employing the Online Form via the following link, - Canceling a Transaction – advising that the product or service had not been provided and that the Customer is therefore canceled the order from the Supplier, Provider or Seller.

5.1.3 Product or service not received due to bankruptcy, receivership or winding-up. If the product or service was not provided by the Supplier, Provider or Seller for any of these reasons, Trust-net will reimburse the Customer with the payments already deducted from the Customer's account. The Customer has notified Trust-net, within 30 days from the date the credit card was charged, through the Online Form via the following link, - Canceling a Transaction, - advising that the product or service had not been provided and that the Customer is therefore canceling the order from the Supplier, Provider or Seller. 

5.1.4 Purchase of subscription for a limited period of time through Trust-net will notify the Supplier, Provider or Seller of the cancellation of the subscription and will block further charges from the Customer's account. Notification of Cancellation of the subscription must be given through the Online Form via the following link, - Canceling a Transaction, - up to 2 (two) business days period to the monthly account-charge date. 

5.2 For the first time in the Middle East, the Customer receives full security and assurances that he will receive the product or service he ordered, and in case of cancellation , for any of the reasons described above, he will be reimbursed. 

5.3 Merchant Trust Ltd`s. policy is providing securely transformation of funds from the customer to the Supplier, Provider or Seller and preventing payments to a Supplier, Provider or Seller who fails to fulfill his commitments to the Customer . Whether it was paid by a credit card, electronic check or any other form of payment. 

5.4 Trust-net will do everything in its power to protect the Customer and to provide full assurance and security when purchasing through the Internet via the medium of Trust-net. 

5.5 Clarification: The Suppliers, Providers and Sellers displaying their products or services on Trust-net's website. Products or services which displayed on the website are NOT the property of Trust-net, unless otherwise specified.

 

6. Security of the Purchase Procedure 

6.1 Trust-net uses the best security system?  That Available to electronic commerce geared to the objective of securing the purchase procedure through it, of either a product or a service, as well as the right to privacy and confidentiality of its Customers. 

6.2  "Sensitive" classified / information is transferred using the SSL encryption system. The system is supervised using the most secured methods and means that have been purchased or developed by Trust-net or affiliated companies.

 

7. Notifications of Execution and Invoices

7.1After the order has been confirmed and the payment executed, Trust-net's payment server will send a notification by e-mail to the Customer, confirming the reception of the order.

The Receipt of the payment received from the Supplier, Provider or Seller will be attached to each delivery and forwarded to the address provided by the Customer.

8. Canceling a Transaction 

8.1 In addition to the Event, Action and Conditions detailed in Section 5.1.3 above, the Customer is entitled to cancel the order and be reimbursed the customer has to inform Trust-net up to 2 business days. Customer can be reimbursed even after he paid for the product or service, in accordance with the Consumer Protection Laws applicable in Israel. 

8.2 In addition to the Clauses detailed above, Trust-net has decided to improve its services and to enable its Customers canceling a transaction within 30 days from the date of its execution, for so long as the Customer acted in good faith and for so long as the payment for the product or service has been debited to the Customer's account in accordance to the Rules applied by the Credit Card Companies - (Visa or Master Card) - and the FDIC. In such a case, Trust-net will refund the Customer with the same amount as it was  paid by the Customer, upon the condition that a written confirmation from the Supplier, Provider or Seller stating that the product or service was returned to them in its original package, is attached to the Customer's canceling notification the order.

Upon receiving the Customer's notification of cancellation and the confirmation from the Supplier, Provider or Seller, Netpay will cancel the transaction and refund the Customer with the amount actually paid for the order as aforesaid.

 

9. No Data Hoarding 

9.1 Data concerning Trust-net's Customers, credit card details, bank information and payments will not be hoarded (stored) by the payment servers employed by the Suppliers, Provider or Sellers supplying products or services and forwarding debit notifications to Trust-net.

 

10.Transparency 

10.1 Trust-net will provide access to every Customer wishing to verify the status of his order, and to every Supplier, Provider or Seller as to the status of ordered products or services carried-out.  Trust-net will do this through the Order Follow-Up system developed in order to ensure sound and effective operations in its Customer service.

 

11. Complaints and Enquiries 

11.1 Enquiries concerning products or services purchased should be forwarded directly to the Supplier, Provider or Seller, per the phone number and address provided on their Websites. 

11.2 Complaints concerning Suppliers, Providers or Sellers and problems with them should be reported to Trust-net through the medium of the Online Form on the website.

 

12. Secrecy and Confidentiality 

12.1 Trust-net is committed to safeguarding every detail of information provided to  Trust-net through this Website, in accordance with Israel’s? Privacy Protection Laws. 

 

13. Applicable Law and Local Jurisdiction 

13.1 This Statement of Rules and Regulations is a full and valid contract between the Customer and Trust-net. 

13.2 This Statement of Rules and Regulations is additional to the agreement made between the Customer and the Supplier, Provider or Seller concerning the purchase of products or services.

13.3 In the event of a contradiction or possible differences in interpretation between this Statement and the Statement of a Supplier, Provider or Seller, what is stated in this document will always over-rule.

 

14. Updating 

14.1 This Statement of Rules and Regulations was updated to Monday, September 24, 2007 and became valid beginning Tuesday, September 25, 2007 at 00:00.
